Developer Reaches Favorable Settlement in San Diego Construction Case
September, 2005 - Green & Hall recently concluded the handling of a multiple-party lawsuit in San Diego County alleging various construction deficiencies against a residential developer. Green & Hall and its clients succeeded in resolving the case before trial for approximately 1/3 of plaintiffs' repair estimate, and with the clients contributing less than 3 percent of the total settlement.

California Supreme Court Denies Review of Favorable Appellate Ruling Green & Hall Secured For Grove Properties Company
April, 2005 - The California Supreme Court on April 27, 2005 denied a petition that sought review of a favorable attorneys' fees ruling Green & Hall secured on appeal for client Grove Properties Company. In the underlying case, ABF Capital Corporation sued Grove for breach of contract. The trial court sustained a demurrer Green & Hall filed on behalf of Grove, but denied a subsequent motion for attorneys' fees. On appeal, Dennis Luckman and Colin Holley succeeded in reversing the trial court's denial of attorneys' fees, by convincing the Court of Appeal that California public policy embodied in Civil Code section 1717(a) required reciprocal application of the unilateral attorneys' fees provision contained in the contract at issue. The decision of the Court of Appeal is particularly notable for its holding, in agreement with Green & Hall's position, that business entities are within the class of persons protected by section 1717(a).
